Terms of Service

Draft pending legal review. These terms describe how Marque is intended to work and are published so the intent is on the record, but they have not been reviewed by a solicitor and are not legal advice. If you are relying on them for anything material, ask us — we would rather answer than have you assume.
These terms govern your use of Marque, a hosted service for managing workshop jobs, parts and vehicles, operated by Cinolla Software Limited. Creating an account or using the service means agreeing to them.
1. What you are getting
We grant you a non-exclusive, non-transferable right to use Marque for running your own workshop for as long as your account is active. The software is provided as a service — you are not buying a copy, and there is nothing to install beyond the mobile app if you choose to use it.
2. Your account and your people
You are responsible for who you give logins to and for what they do with them. Owner and manager accounts require two-factor sign-in, because they can see every customer, vehicle and invoice the workshop holds.
While you are still on the free trial you can put that setup off — we will ask, and ask again about once a week, but nothing is blocked. Once the account is being paid for, it is required and cannot be turned off on request. The reasoning is simply that by then there are real customers in there.
You may also issue logins to bodyshops and other subcontractors. Those accounts are deliberately restricted to the pieces you have sent to that company and can never see your customers or your prices, but they are still logins you have handed out and you remain responsible for them.
3. Your data is yours
Everything you put into Marque — customers, vehicles, jobs, parts, photographs, condition reports — remains yours. We store and process it to provide the service and for no other purpose. We do not sell it, we do not use it to train anything, and we do not share it with other workshops.
Each workshop's data is separated within the service. We hold it in the United Kingdom.
4. Photographs, condition reports and signatures
Marque is designed to hold evidence: photographs of a vehicle's condition, marks on a condition report, and a customer's signature against that report. Two consequences follow, and both are deliberate.
First, a signed condition report cannot be edited. Removing the signature is the only way to change one, and doing so is recorded — because a record that can be altered after somebody signed it is not evidence of anything.
Second, that material may include personal data belonging to your customers, including their signature. For that data you are the controller and we are the processor. Collecting it lawfully, telling your customers why you hold it, and answering their requests about it are your responsibility. We will help you find or export anything you need.
5. Connecting QuickBooks
You may connect a QuickBooks Online company to Marque. If you do:
We read your customers and inventory items so they can be used on jobs without retyping. Marque does not write anything back into your accounts. Intuit's accounting permission does not come in a read-only form, so the access we hold is technically capable of writing — we simply do not, and if that ever changes we will say so before it does.
The connection is held as tokens, encrypted, against your workshop only. You can disconnect at any time from Settings, or from within QuickBooks, and either way the connection stops working immediately. Disconnecting leaves the customers and parts already brought across in place — they are your records by then.
6. Other services we pass information to
Marque can look a vehicle up by registration through the DVLA, follow parcels through Parcel, and send email through Amazon Web Services. Each of those receives only what the task needs — a registration, a tracking number, an address and a message. Vehicle lookups and parcel tracking are optional and only happen if you enter the relevant key.
7. Email we send
Marque sends transactional email only: things a customer or a member of your staff has asked for or needs in order to use the service. We do not send marketing on your behalf, and we do not add your customers to any list. Addresses that hard-bounce or complain are suppressed automatically, because continuing to send to them would harm deliverability for every workshop using the service.
8. Availability
We aim to keep Marque available and we deploy changes without taking it down where we can, but we do not offer a guaranteed uptime figure and you should not plan around one. If something is broken, telling us is the fastest route to it being fixed.
9. Trial
A new workshop gets 14 days free, and we do not ask for a card to start one. You can give yourself a further 7 days from inside the app, once. When a trial ends without a subscription the account becomes read-only: everything you have put in is still there and you can still look at all of it, but you cannot add to it or change it until the account is paid for. We do not delete anything for non-payment.
10. Fees
Marque is £49 per workshop per month, or £490 per workshop per year, both plus VAT. The price covers everyone at your workshop — we do not charge per person. Where we have agreed a different price with you, that is the one that applies.
Subscriptions renew automatically at the end of each billing period until you cancel, and payment is taken on the card you provide. Card details are handled by Stripe and never reach us. We will give at least 30 days' notice in the app or by email before changing a price, and a change never applies part-way through a period you have already paid for.
11. Ending it
You may stop using Marque whenever you like, and you can cancel your subscription yourself from the billing screen. Cancelling stops the next payment; it does not refund the period you are in, and you keep access until that period ends. On request we will provide an export of your data in a usable format, and after a reasonable period we will delete it. We may suspend an account for non-payment or for use that puts the service or other customers at risk, and we will tell you why.
12. Liability
Marque helps you keep records; it does not replace your own judgement, your insurance, or your legal obligations. To the extent the law allows, our liability is limited to the fees you have paid us in the preceding twelve months. Nothing here limits liability that cannot lawfully be limited.
13. Changes to these terms
We may update these terms. Material changes will be notified in the app, and the date at the top of this page always says when it last changed.
14. Law
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
